Deed Restriction Disclosure. Buyer understands property has a short term (3 month) deed restriction prohibiting the property from being sold/encumbered for more than 120% of total purchase price.

Closing cost enormous!?

I bought a house at auction from Williams and Williams Real Estate Auction. It ended up that I had to use their title company Williams Title Company. The closing costs for a $71,000 home was over $7000!!! Over 10% of the purchase price. I thought I got a deal, but it turned out that the closing costs really sank the deal once I gave my earnest money at time of the auction.

The real kicker is the title insurance which was over 50% more expensive than the closest competitor for title insurance in that area.

Deal or rip off!?

Ed, if you want to pay close to the asking price when the house was last on the market then go to a W & W action. You'll be paying too much trust me. You'll also have to pay the buyers premium to W & W. You are better off finding a property you like, getting an agent and writing up an offer and deal directly with the seller. These guys just take a cut. NO DEALS at least not from my experience.

I have found in my dealings with W & W has been they take properties and set the auction dates then for the deals they want they move the date up one day then buy them without any one aware of the changed dates. Works well for them with out any competition.

All of the "rules" of the auction are clearly written in their documentation. As a previous real estate closer, I can tell you that NO ONE READS the documentation and then think they were scammed. There is almost always a buyer's premium in a real estate auction and it is clearly stated in all documentation by all auction houses. Having said that...for the most part in Oklahoma, you don't get a good deal at an auction because people get caught up in the bidding and go over their budget and forget about the 10% premium that is tacked on. ALSO, the seller has to pay W&W if they don't accept the bid! You'd know that if you talked to them about how they do business on the seller's end of the deal.

I think a lot of complaints here are based on people's misunderstanding of auction rules. in the real world, an auction is not like eBay. Bidders do not know the reserve price - EVER. Not before. Not during. And not even AFTER the auction is over.



In the real world, the seller says "No sale of high bid does not meet or exceed $nnnn". The auction proceeds, and at the end, if the high bid does not meet the seller's reserve, then there is no sale.



This isn't eBay, where you are told immediately if your bid does not meet the reserve. In a real auction, you have no idea whether your bid meets the reserve until the bidding is completely over. And at that time, the seller has the right to refuse sale if the reserve is not met.



And there is no rule that says that the reserve must EVER be disclosed (because the seller may choose to auction the item again). The reserve is known only to the seller and the auction company representing them.



There is nothing sneaky about this. These are auction rules that have been in place probably since auctions began. And if you think about them you will see that they are quite fair to everyone involved.



Again, this is not eBay. You do not get told that your offer doesn't meet reserve with every bid you place. It's more like "Going, going... gone. I'm sorry sir, your bid does not meet reserve."



And no one should complain about this if they understand the rules governing auctions ahead of time.

This company sold my ranch. They can take diamonds and sell as rocks and justify the Auction as being done and after all diamonds are rocks. They play fast and loose with rules, ethics and professionalism. They probably should stick to selling foreclosed and bankrupt housing, don't even consider a quality property. Only after their auctions will you maybe found out the true nature of this company is based on expediency and economic feasibility or cheap.

I have purchased 3 homes from Williams auction... all without a problem. One was cash and 2 were financed. Smooth transaction and we used a local title company. I will definately keep using them.

No Robert - you do need utilities for the banks appraisal. But I do have a good update to my story. Williams and Williams is returning our down payment. They did not have to do that, and could have taken us for a lot more. So I have to say, in the end, I don't have any complaint against them. They were just following their rules.

Borrow or rent a generator and have a electrician hook it up for appraiser should not need power for apprasisal.

We bought a house at their auction. Was the winning bid and it was accepted. We were preapproved, and told the company we were financing. The house needs about $200 worth of work to get all the utilities working, which we were willing to do. Turns out we CAN'T fix anything - the bank won't finance without the appraisal which requires utilities, so we are out the deposit - which was 5% of the bid. When the house was sold "as is" we didn't realize we couldn't do minor fixes before closing. Maybe they followed all the rules. But not common sense. The seller lost the sale, and will continue to pay insurance and taxes until someone with cash in hand comes along, the auction company didn't sell the house, so they aren't getting paid, and we're out $8 grand, and a house we really loved and wanted to live in the rest of our lives.

I bought two houses from W&W. Went as smoot as gold. Fair all the way around and fast. Went and bid on a house with Auction.com. Won the bid was to get acceptance or not in 15 days and a month later I was fighting with them to hear an answer and get my deposit back. I had sent deposit next day after auction and they said they never knew I sent it ? Took six weeks to get my money back. Now ther are crooks.

I bought a house in 2006 through Williams and Williams and closed at the end of July. I went out with a contractor to get a bid the first of August to find yellow tape around the house and a notice from the city that the building was condemned and to be demolished. I called Williams and williams, sent them copies of certified mail that the bank they represented was sent and had prior knowledge and did not disclose it and a lady named Karen in Tulsa had them refund my money and reverse the sell. I went on to buy many more properties and have had nothing but positive experiences with w&w. I have not bought since 2007 but hope they are still as ethical now as they where then.

Same thing auction this Past weekend in Tulsa turns out winning bidder was with Williams auction. I believe all the bidders were just window dressing and it was a forgone conclusion that no one would get this property but the Williams bidder. Sad people sold stock to have cash brought in inspectors and decorators. Bit slimy

I have been the high bidder on two different houses. Both times got the call saying our offer was rejected. First time I raised my offer by five thousand. Second time I doubled my own high bid by raising it another 25k. Again it was rejected. What is the deal? What does *** Mae expect?

Was highest cash bidder in person - found out they sold it to someone else for same bid (themselves?). Turned them in twice to Dept. of Commerce. Their lawyers will turn everything around, and lie like crazy. They are slippery....don't even bother attending their auctions - and don't send them earnest money - they will try to keep it illegally. Run, don't walk from them!!!

I was recently a high bidder at a WW auction on a Fannie Mae foreclosure. The auction company doesn't reject the bid the seller does. And if you you bid on a home that you cannot get financing for they keep your earnest money for wasting there time. Make sure your approved first. Yeah it sucks but just because the auction company puts a minimum bid on it doesn't mean the seller will accept it. I just got a house minimum bid 10k paid 85500till Fannie Mae accepted

Their claim that there is no reserve is a lie (and they have a lawyer on staff paid to cover it up)



Stay away from WIlliams & Williams is my conclusion... but if you do decide to bid, know that you will not guaranteed to get the place. If you want to play that game good luck. If you want an genuine auction, look elsewhere.

It's amzing how uninformed the general public can be. I wa the high bidder on a house by WW and yes the lender rejected the bid and WW called me to up my bid which I rejected. They immediately returned my earnest check in the mail that was never negotiated. This is not WW fault kids, the seller drives this activity. Two months latter the same property came up for auction with another company and the seller approve my bid which was 12% less than the first aucton. If you are not willing to educate yourself or have the business sense, don't play the game
